Terms and Conditions of Hire

Provider – Mr Tim Boryer trading as Reflexions Photobooths.
Customer – The person(s) booking Reflexions Photobooths for their event.

Photo Booth – One ‘Mirror Me’ product and when hired in addition, a social media station and/or green screen.

The following contract and its terms will set forth an agreement between the Provider and the Customer for the hire of the Photo Booth

SERVICE PERIOD

The Provider guarantees the Photo Booth will be operational for at least 80% of the rental period. Any downtime in excess of this will be refunded on a pro-rata basis if this is caused by technical or mechanical difficulties. The Provider will arrive at the venue approximately 60 minutes before the rental period to ensure the successful set up and operation of the equipment.

PAYMENT

A £100 non-refundable deposit is required to reserve the event date. The balance is payable, in full, 30 days before the event.

ADDITIONAL USE

If the Customer requests an extension to the agreed hire period of the Photo Booth, the overage in rental time will be billed to the Customer at the appropriate rate depending on which day of the week the rental is taking place and whether the additional hours are for operational use or idle periods. Payment for any additional hire of the Photo Booth must be paid for before additional hours are provided.

ACCESS, SPACE & POWER FOR PHOTO BOOTH

It is the responsibility of the Customer to secure permission for the set up and running of the Photo Booth with the venue management.

 

The Customer will arrange for an appropriate space for the Photo Booth at least 2m high, 1.8m wide and 3m long.

 

The Customer will ensure there is a 13 amp power supply adjacent to the area the Photo Booth will be sited and will ensure that the power cable is not laid across avenues of human traffic.

 

The Customer will ensure that the venue is able to provide acceptable parking to load and unload the Photo Booth.

 

Where the venue is situated above the ground floor of the property, the Customer will ensure that lifts are available to transport the Photo Booth.

EVENT DATE CHANGES

The Customer may make a request to change the date of an event providing the request is made in writing prior to the original event. Any change in date is subject to availability of a Photo Booth and if no Photo Booth can be provided the event will be cancelled and the deposit remains non-refundable. If the request to change the event date is made within 30 days of the original event date and the Provider is unable to provide a Photo Booth for the new event date the event will be cancelled and the deposit remains non-refundable and the Customer will be liable for 50% of the remaining balance of the cost of hire. If a change of date cannot be accommodated by the Provider within 7 days of the original event and the Customer has paid in full the Customer will both forfeit the non-refundable deposit of £100 and 100% of the remaining balance of the cost of hire.

CANCELLATIONS

The Customer may cancel the hire of a Photo Booth at any time prior to 30 days in advance of the event date but will forfeit the non-refundable deposit of £100. Any cancellation made by the Customer within 30 days prior to the event date will forfeit the non-refundable deposit of £100 and the Customer will be liable for 50% of the remaining balance of the cost of hire. Any cancellation made by the Customer within 7 days prior to the event date will forfeit the non-refundable deposit of £100 and the Customer will be liable for 100% of the remaining balance of the cost of hire.

 

If the Provider cancels the event due to illness, accident, vehicle breakdown, adverse weather conditions or other reasons beyond the control of the Provider, the Provider will refund the Customer all payments made. In these circumstances only will the non-refundable deposit become refundable.

 

Any failure by the Customer to make timely payments may result in cancellation of this agreement. The Provider will make every attempt to provide notice to the Customer before cancellation occurs.

 

TERMINATION OF BOOKING

 Any abuse or violent behaviour by the Customer and/or their guests to the Provider’s equipment or members of staff will result in immediate termination of the Provider’s services. If under such circumstances the Provider decides to terminate the Photo Booth booking, the Provider will not issue any refunds.

DAMAGE TO PROVIDER’S EQUIPMENT

The Customer shall be responsible for any damage or loss to the Provider’s equipment caused by any misuse of the Provider’s equipment by the Customer or its guests and the Customer will be liable for the cost of repairs or replacement of damaged or broken items. This does not apply to accidental damage to items in the ‘props box’.

INDEMNIFICATION

Customer agrees to, and understands the following:

The Customer agrees to indemnify the Provider against any liability from any claims, suits, costs or damages including but not limited to liability for personal injury of any person at the event or any damage to property.

If the Provider fails to comply with the terms of this agreement they shall only be liable for funds received. They shall not be liable for any further consequential damages.

The Provider is not responsible for difficulties caused by the event venue’s wifi connectivity.

The Provider reserves all rights to the photographs and digital images captured during the event and may use them for demonstration, publication, or other purposes. Original media and copyrights remain the exclusive property of the Provider.

In the unlikely event that the digital copies of the Customer’s event become corrupted or are lost or stolen, the Provider will compensate the Customer up to a total value of £100

Any modification of this agreement should be made in writing and signed by both parties.
